AuctionErotica.com is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you spot a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting us.
Rights To Suspend or Terminate.
You agree that AuctionErotica.com, in its own discretion, may terminate any auction or use of the service immediately and without notice if (a) We believe that you are not abiding by the general rules of this web-site (b) You have repeatedly broken a certain term (c) You have listed a suspicious item (d) We believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.
Your Conduct.
You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.
You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, or vulgar material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.
Membership.
Membership to AuctionErotica.com is only available to those you can form a legally binding contract. This web-site does not permit minors (under 18) or 21 is some jurisdictions to register. If any member fails to signup with their correct age the account will be terminated immediately.
General Terms.
AuctionErotica.com acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.
AuctionErotica.com shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. AuctionErotica.com shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.
AuctionErotica.com assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as we can.
Prohibited Items.
AuctionErotica.com does not allow the following items to be listed:
- Auctions involving minors
This includes any auction depicting or describing persons under the age of 18 or APPEARING under the age of 18. Items depicting or describing bestiality
This includes any item depicting or describing sex with animals.
- "Scat" items
Scat items are those items that depict or describe human feces
- "Piss" items
Any item depicting or describing someone urinating
- "Torture" items
Any items depicting or describing torture or physical abuse. This is not meant to exclude standard bondage items. We specifically exclude items related to torture and physical abuse.
- "Import" pictures or videos
Any picture or video not produced in the United States.
- Raffle auctions
This includes any item where a lister is auctioning "chances to win", "tickets", etc. An auction must be for a good or service.
- Sexual acts or favors
Auctions for sexual acts or favors or auctions that imply sexual acts or favors between the lister and the bidder
- Rape items
This includes any item that describes or depicts acts of rape, whether real or simulated.
- Incest items
Auctions describing or depicting incest.
- Bodily Fluids
Whether semen, urine, blood, or other in liquid or frozen form.
- Prescription drugs
Auctions selling prescription drugs
- Items that violate any local, state, or federal law whether by the item itself or the method by which it is delivered.
- Items that violate federal statutes
Federal statutes include but are not limited to:

United States Code Title 18, Part 1, Chapter 110, Section 2256
United States Code Title 18, Part1, Chapter 71
- Production/Backup services
You can not list an item and then state that you are selling only the "production service" of the item or a "backup copy" of an item that the bidder may already own. This is a clear and blatant violation of copyright.
- "Public domain" media
Media acquired from the "public domain" may not be listed. If the media being sold is in the public domain then there is no way that you can verify the age of the person appearing in the media is over the age of 18.
- If a seller lists any of the prohibited items on our Site, the items will be removed and the seller's account will be immediately suspended without recourse or explanation.
Laws.
These Terms of Service shall be governed by and constructed in accordance with the laws of The United States of America and any disputes will be decided only by the Courts of Florida in the County of Broward.

This website contains adult material. All members have certified that the pictures or items submitted are of individuals 18 years of age or older and all primary producers have certified that they have complied with 28 C.F.R. 75 thereby exempting AuctionErotica.com from the record keeping requirements of 18 U.S.C. 2257(a)-(c).
